The Role of An Independent Vocational Expert (VE)

The ALJ's often use VE's testimony to determine ability to work at past relevant work or alternative jobs in the National economy based on the claimant's Residual Functional Capacity (RFC), skills, age, education, etc. Most VE's are hired by the SSA and are provided hypothetical scenarios and never personally evaluate the claimants. The cost / benefit ratio usually prohibits claimants or representatives from incurring the expense of hiring their own expert witnesses.

As an alternative to the SSA's Vocational Experts, an independent VE who does not contract with the SSA, can provide similar information to the ALJ with a written report in the form of interrogatories. These interrogatories are provided to the VE by the claimant's attorney and filled out by an independent VE at a much more affordable rate than the traditional cost of evaluation and live appearance. 

Since the SSA accepts hearsay evidence, it becomes part of the permanent record without the presence of the independent VE at a Hearing and is not subject to cross examination.
